• 1 Scope

For orders for goods via a contact form, by telephone, email or WhatsApp on 0178 – 7248163 or 07081 – 15 64 073, the following general terms and conditions apply exclusively to you - as long as this does not deprive you of further consumer protection at your place of residence in Europe Terms and conditions in the version valid at the time of the order.

You can download the text to your computer or print it out. Any regulations that deviate from these conditions only apply if they have been confirmed by us in text form.

• 2 Conclusion of contract

(1) Information about goods and prices within each ordering process is subject to change and non-binding. Rather, by placing your order by email, telephone or WhatsApp, you first make a binding purchase offer, which still requires my acceptance. The purchase contract for the goods is only validly concluded once your order has been accepted. I am under no obligation to accept your purchase offer.

(2) I will accept your order as long as I confirm the dispatch of the goods by email.

• 3 Cancellation policy

Right of withdrawal

You have the right to cancel this contract within fourteen days without giving any reasons. The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the goods,

if you have ordered one or more goods as part of a uniform order and the goods or goods are or are delivered uniformly;

if you have ordered several goods as part of a single order and the goods are delivered separately;

If several of the above alternatives are present, the cancellation period only begins to run when you or a third party named by you who is not the carrier has taken possession of the last goods or the last partial shipment or the last item .

inform you about your decision to revoke this contract by means of a clear statement (at least verbally, but also in text form, i.e. by fax or email). If you want to send me a letter, that is of course also possible.

Consequences of revocation

If you cancel this contract, I will pay you all payments received from you, including delivery costs (except for additional costs resulting from you choosing a method of delivery other than that offered by us, have chosen the cheapest standard delivery), to be repaid immediately and at the latest within fourteen days from the day on which I received notification of your cancellation of this contract. For this repayment I will use the same payment method that you used for the original transaction, unless something different was expressly agreed with you; under no circumstances will you be charged any fees for this repayment.

I can refuse the repayment until I have received the goods back or until you have provided evidence that you have sent the goods back, whichever is the earlier.

You must return or hand over the goods to me immediately and in any case no later than fourteen days from the day on which you inform us of your cancellation of this contract. The deadline is met if you send the goods before the fourteen day period has expired.

The following applies to the return shipping costs: If you use a prepaid return label provided by me, the return shipping is free of charge for you. If you do not use our return label, you will have to bear the direct costs of the return.

You are only liable for any loss in value of the goods if this loss in value is due to the handling other than what is necessary to establish the nature, characteristics and functionality of the goods.

• 4 Delivery

(1) Standard deliveries in Germany are made from Bad Wildbad to the delivery address specified when ordering or to a DHL packing station within Germany. Delivery to PO box addresses is not possible.

For standard delivery via DHL within Germany, your order will be delivered within 2-5 working days.

(2) Standard deliveries to addresses within the EU only take place if the billing address is within Germany or advance payment is agreed.

For deliveries within the EU, the shipping cost is calculated based on the shipping weight and will be communicated with the purchase offer and/or the order confirmation.

(3) I expressly reserve the right to change, expand, restrict or discontinue the delivery types mentioned in the aforementioned § 4 paragraphs 1 and 2 or to discontinue them in part or in whole at any time and without giving reasons to offer more. The standard delivery method in accordance with Section 4 Paragraph 1 is excluded from this.

(4) Statutory holidays and public holidays, which vary within Germany, affect the delivery time of your order and lead to a postponement of delivery by up to two working days following the public holiday.

(5) I am entitled to make partial deliveries if this is reasonable for you based on a consideration of your and our interests. In the case of partial deliveries, I will bear the resulting additional shipping costs. Partial deliveries are sent at my risk. Upon receipt of each partial delivery, the risk for the delivered items passes to you. If I am in default with outstanding partial services or if outstanding partial services are not possible for me, you are entitled to withdraw from the contract as a whole or to demand compensation for non-fulfillment of the entire obligation whenever the partial delivery is not of interest to you.

• 5 means of payment, discounts, due date, default and retention of title

(1)Depending on the amount of your order, you will be offered a choice of the following payment options:

1. a) Bank transfer
2. b) PayPal

(2) The purchase price is due upon complete delivery, i.e. handover of the goods by the parcel deliverer.

(3) If the invoice amount to be paid is not credited to my account on time when purchasing on account, you will automatically be in default. Even without further reminders, you are then also obliged to pay the statutory default interest amounting to five percentage points above the respective base interest rate announced by the European Central Bank and the further damages caused by the delay, in particular the further collection costs. However, in any case, you reserve the right to prove that no or lesser damage has occurred.

• 6 claims for defects

(1) The product images do not always have to match the appearance of the delivered products. In particular, changes in the appearance and features of the products may occur after the manufacturer renews the product range. There are no claims for defects if the changes are reasonable for the customer.

(2) If the goods are defective, I will provide subsequent fulfillment within a reasonable period of time, i.e. H. either ensure a replacement delivery or remedy the defects. If the supplementary performance you have chosen is only possible with disproportionate costs, we are entitled to provide supplementary performance in a different form. We will bear the expenses required for subsequent performance. If we are unable to provide subsequent fulfillment, you have the right to cancel the purchase.

(3) Defective goods must be returned to me.

(4) Claims for defects expire within 2 years from the time the goods are delivered.

(5) I must bear the costs for return shipping in the event of a defect.

• 7 Compensation for damages

Compensation for damages due to breach of an obligation arising from the contractual relationship must be paid under the legal requirements. The same applies to claims for damages based on the Product Liability Act. All instructions on the packaging and inserts must be observed. No liability is assumed for any application and/or handling that deviates from this.

• 8 Data protection/credit check

The data necessary for business transactions is stored. All personal data will be treated confidentially and will not be passed on to third parties.

• 9 Miscellaneous

(1) I reserve the right to change the general terms and conditions at any time. These are available at any time in their current version on my website, as a PDF file for downloading and printing.

(2) German law applies to customers in Germany. For customers residing abroad, the purchasing law of the country in which the customer usually resides applies.
